By accessing our website (www.funneldelivery.com), engaging our services, or participating in our promotional offers, you agree to be bound by these Terms and Conditions (“Terms”). These Terms govern your use of our services, including website development, ad campaign management, and white-label funnel services. If you do not agree, please do not use our website or services.

1. Services

We provide done-for-you sales funnel services, including website development, ad campaigns, graphic design, email writing, custom coding, SEO optimization, brand consistency, and A/B split testing. White-label services are available for agencies. Specific terms for each service are detailed in individual service agreements.

2. Promotional Offer: Free First Month of Ads

Our “Buy a Custom Funnel, Get 1st Month of Ads FREE” offer is available to new clients purchasing a custom funnel in May 2025, subject to the following:

• Eligibility: Limited to new clients, subject to availability.
• Scope: Covers ad campaign management fees for 30 days from launch. Clients cover all ad spend costs (e.g., payments to Facebook or Google).
• Conditions: Requires full payment for the funnel package and a signed service agreement. Non-transferable, non-refundable, and cannot be combined with other offers.

We may disqualify clients who misuse this offer.

3. Client Obligations

• Information: Provide accurate business details, CRM access, ad account credentials, and branding guidelines.
• Payment: Fees are due per the service agreement. Late payments incur a 5% monthly fee. Third-party costs (e.g., ad spend) are client responsibilities.
• Content: Ensure all provided content (e.g., images, text) complies with laws and does not infringe third-party rights. We are not liable for issues arising from client content.

4. Service Delivery

• Timelines: Funnels are typically delivered in 7-14 days, ad campaigns in 48 hours to two weeks. Delays may occur due to project complexity or client responsiveness.
• Revisions: Unlimited revisions within project scope are included. Additional changes may incur fees.
• White-Label: Agencies may brand funnels as their own. We will not disclose our role unless legally required.

5. Performance

We aim for high-converting funnels and effective ads but do not guarantee specific results (e.g., conversions, revenue). Historical data (e.g., $20M+ client revenue) is not a guarantee of future performance. Clients must provide access to analytics platforms for performance tracking.

6. Free Funnel Fix Session

The 30-minute Free Funnel Fix Session is a complimentary consultation to discuss your needs. It does not obligate you to purchase services or guarantee outcomes. Sessions are scheduled via our website, subject to availability.

7. Intellectual Property

• Ownership: Funnels and campaigns remain our property until fully paid, then transfer to the client (except white-label funnels, which agencies brand but do not own).
• Reuse: We may reuse custom code or designs unless otherwise agreed.
• License: Clients grant us a non-exclusive license to use their branding and data for service delivery and case studies (unless opted out).

8. Confidentiality

We protect your confidential information, sharing it only with necessary subcontractors or as required by law. Clients must keep our methods and pricing confidential.

9. Refunds and Cancellations

• Refunds: No refunds for completed services or promotional offers unless stated in the service agreement. If we fail to launch a funnel due to our error, we offer a pro-rata refund or remedy.
• Cancellations: Requires 30 days’ written notice. Fees for completed work are non-refundable.

10. Liability

Our liability is limited to the amount paid for the specific service. We are not liable for indirect damages, such as lost profits or data loss, to the extent permitted by law.

11. Indemnification

Clients indemnify us against claims arising from their use of our services, including legal violations or third-party rights infringement.

12. Termination

We may terminate services for clients who violate these Terms, fail to pay, or engage in illegal activities.

13. Governing Law

These Terms are governed by Delaware, USA law. Disputes will be resolved in Delaware courts.

14. Changes to Terms

We may update these Terms, with changes posted on our website. Continued use constitutes acceptance.
